Oregon’s Public Indecency Laws & Portland’s Municipal Ordinance

Not all indecent exposure charges in Portland arise under the same law, and that distinction shapes your defense. Oregon state law and the Portland City Code define these offenses differently and require the prosecution to prove different elements.

Oregon Public Indecency: ORS 163.465

Under ORS 163.465, public indecency occurs when a person engages in sexual intercourse, oral or anal sexual intercourse, masturbation, or exposes their genitals in or in view of a public place with the intent to arouse sexual desire. This offense is a Class A misdemeanor, carrying up to 364 days in jail and a fine of up to $6,250. If the defendant has a prior conviction for public indecency or for a sex crime under ORS 163.355 through 163.445 or ORS 163.665 through 163.693, the charge escalates to a Class C felony, which carries up to five years in prison and a fine of up to $125,000.

Oregon Private Indecency: ORS 163.467

Private indecency under ORS 163.467 applies when a person exposes their genitals with sexual intent in a place where another person has a reasonable expectation of privacy, such as a residence, yard, workplace, or office, the exposure would reasonably be expected to alarm or annoy the other person, and the person knows the other party didn’t consent. Like public indecency, this offense is a Class A misdemeanor, carrying up to 364 days in jail and a fine of up to $6,250.

Portland City Code PCC 14A.40.030

Portland’s municipal ordinance is broader than Oregon state law in one critical way: it removes the sexual intent requirement. PCC 14A.40.030 prohibits genital exposure in a public place or in a place visible from a public place that is open or available to people regardless of sex, with no regard to the person’s intent. Conduct that wouldn’t meet the intent threshold under ORS 163.465 can still result in a criminal charge under the city ordinance. The Oregon Supreme Court upheld Portland’s ordinance as valid in City of Portland v. Jackson (1993). A defendant in Portland may face charges under state law, the city ordinance, or both. The applicable standards differ significantly.
